PRE-CONTRACTUAL INFORMATION - GENERAL CONDITIONS OF SALE

The general conditions of sale and use set out below (hereinafter “General Conditions”) regulate access to the website www.palomastore.it (hereinafter “Site”) and its use and apply to all sales (hereinafter “Services”) provided by Gloria Capuzzo, with registered office in Monselice (PD) – Via Verdi, n° 23/A - VAT number 05590310289 of which it is the owner (hereinafter “Seller”).

The use of the Services is permitted to those who:

  • be a consumer, where consumer means a natural person who acts for purposes other than any entrepreneurial, commercial, artisanal or professional activity he may carry out;
  • has reached the age of majority;
  • have read the Privacy Policy relating to the processing of personal data;
  • has accepted these General Conditions.
1. Object and scope of application
These General Conditions apply to the Services on the Site. Any new services will be subject to these General Conditions, unless otherwise specified on the Site.

The offer and sale on the Site constitute a distance contract governed by articles 50 et seq. of Legislative Decree 6 September 2005, n. 206 ("Consumer Code") and by Legislative Decree 9 April 2003 n. 70, containing the rules of electronic commerce.

These General Conditions of Sale may be updated or modified at any time, it being understood that for each purchase contract the General Conditions published at the time of sending the purchase order apply. To this end, the user is invited to save a copy of the General Conditions from time to time.
    2. Registration methods
    Registration on the Site is free. The user declares that the data provided upon registration on the Site are correct, complete and truthful. Upon registration, the user must also enter a password of his/her choice. Registration will be confirmed by e-mail to the address indicated by the user upon registration. The Seller guarantees that the password for accessing the Site will be used exclusively by the user and not disclosed to third parties. The user may change the password at any time by clicking on the Recover Password link. An e-mail will be sent to set the new password.

    Please note that the data entered at the time of ordering and registration will be processed in accordance with the provisions of the current legislation on privacy. Please refer to the privacy policy.
      3. Product Features
      The products sold are those present in the electronic catalogue published on the Site at the time the order is placed by the buyer and are sold with the characteristics described on the aforementioned Site and according to these general conditions of sale in the version published on the Site itself at the time the order is sent, with the exclusion of any other condition or term.

      Please note that the images and descriptions of the products published on the Site reproduce as faithfully as possible the real characteristics of the products themselves. It is understood that such images and descriptions may not be perfectly representative of the products and must therefore be considered indicative and with the tolerances of use.

      The products for sale on the Site, their prices and/or characteristics are subject to change without notice. Before sending the purchase order, the buyer is invited to verify the final sale price.
        4. Pre-contractual information
        In accordance with Legislative Decree 9 April 2003, n. 70 containing provisions on electronic commerce, the seller informs the user that:
          • to conclude the purchase contract for one or more products on the Site, the user must fill out an order form in electronic format by entering all his/her data (the user declares that the data provided at the time of the order are correct, complete and truthful) and follow all the different phases of the purchase;
          • the user will be able to check and correct any data entry errors before sending the order;
          • the contract is concluded when the order form is registered, after checking the correctness of the order data and payment;
          • Once the order form has been registered, the user will receive a confirmation email containing a summary of the General Conditions, information on the characteristics of the purchased product, a detailed indication of the price, the means of payment used and the methods for exercising the right of withdrawal. It is suggested to keep this email as proof of purchase or to store it on a durable medium.
          5. Terms and conditions of purchase
          The selling price, indicated in the description of each product, is expressed in Euro / € and is inclusive of VAT. Shipping costs must be added to this amount, which also include VAT. The price of the product that will be charged to the user is the one on the Site at the time the order is sent, in addition to the order processing and shipping costs. The price indicated at the time of purchase is not subject to change.

          Except where expressly stated, no payment fees or other costs are payable.

          The products will become the property of the user upon payment of the price by the latter.

          The purchase order will be processed only after receiving confirmation of the authorization to pay the total amount due, consisting of the purchase price and any additional costs, as indicated in the order form.
            6. Payment form
            Payment can be made online by credit/debit card or by PayPal account.

            Your credit card will be charged only after the credit card details used for payment have been verified and authorization for the charge has been released by the credit card company.
              7. Delivery methods and times
              The Seller processes orders from Monday to Friday. Orders are processed on the same day the order is placed, or on the first available working day. Orders placed from Friday afternoon to Sunday will be processed the following Monday.

              The purchased products will be delivered to the address indicated by the Customer in the order within 24 - 48 working hours from when the goods are shipped, at the cost specifically indicated on the Site before sending the order. Once the order has been placed, it is not possible to cancel it or make changes to the order itself. It is possible to monitor the progress of the package via the tracking number provided via email directly from the BRT courier via a direct link. It is also possible to check the tracking by entering this number on the BRT site in "Search shipment".

              It is necessary that the customer provides the shipping data in a complete manner without omitting any important details for the purpose of delivery. In case of forgetfulness or incomplete address it will not be possible in any way to make changes and/or additions. The transport is entrusted to BRT throughout the Italian territory at a cost of €3.90 to be paid by the customer. For all orders from €69 the shipping cost for the buyer is free. The customer will receive an email, directly from the BRT courier, containing the link to track his order.

              The Seller is not responsible for any delays and/or failed deliveries caused by incomplete or inadequately provided addresses at the time of ordering. Any delays will not give the buyer any right to claim damages of any kind.

              ATTENTION: The BRT courier will make two delivery attempts. If the recipient is not present at the second delivery attempt, or the address is incomplete or incorrect, it will not be possible to reschedule the delivery and a storage hold will be requested. Once the order has been placed, it is not possible to cancel it or make changes to the order itself.
                8. Execution of the refund service
                With the conclusion of the contract, or with the payment of the price, the Seller undertakes to perform the requested services.

                In the event that the Seller is unable to send the purchased product, it will promptly notify the user, who will be entitled to a full refund of the payment made within 15 (fifteen) days of sending the communication, excluding any further right of the user to refunds and compensation.
                  9. Warranty and return procedure in case of non-compliant product
                  Pursuant to and for the purposes of European Directive 44/99/EC, Legislative Decree 206/2005 and subsequent amendments (so-called Consumer Code), the Seller guarantees the buyer that the products will be free from design and material defects and compliant with the descriptions published on the Site for a period of 60 (sixty) days from the date of delivery of the products themselves. The application of any guarantee is excluded in the event of use of the product not in accordance with that of the product and the instructions/warnings provided by the Seller or reported in the reference illustrative documentation, on the tags or on the labels.

                  Under penalty of forfeiture of this guarantee, the consumer has the obligation to report any defects and non-conformities within and no later than 60 (sixty) days of discovery, by sending a communication to the e-mail address customerservice@palomastore.it, and indicating therein the defect and/or non-conformity found as well as related photographic documentation.

                  Following receipt of the request and the related documentation, the Seller will verify and evaluate, by means of specific checks, the defects and non-conformities thus reported. The consumer will have the right to repair or replacement of the product, where this is possible in consideration of the availability of the product, and unless the replacement or repair is not excessively costly for the Seller in consideration of the value of the product, the extent of such defect and the possibility that the alternative remedy can be experienced without significant inconvenience for the consumer.

                  Should the Seller be required to refund the consumer the price paid, the refund will be made, where possible, using the same payment method used at the time of purchase or by bank transfer.

                  Procedure for returning non-compliant products:
                    • the user must send the request in writing as soon as possible and in any case within 60 (sixty) days of receiving the product, by sending an email to the following address customerservice@palomastore.it indicating the reason for the return and attaching relevant photographs;
                    • Products must be returned in their original packaging and appropriately packaged for safe shipment;
                    • Returned products must be delivered to the carrier within 7 (seven) days from the date on which the user communicated that the product is damaged or defective.
                    In the event that the Seller does not recognize its responsibility for damage to the returned product, it will send a notification that the returned product cannot be accepted. In this case, the user may request that the defective or damaged product be sent back to him.
                    If the recipient of the product indicated in the order form is different from the person who made the payment for that product, the amount paid for the returned item will be refunded to the person who made the payment. The refund is made with the same payment method used for the purchase.
                    The Seller shall not be liable for any delay beyond its control, including delays caused by the method of purchase or refund, including, for example, delays caused by the refund policies of each credit institution.
                      10. Privacy and data processing

                        11. Content of the Site and intellectual property
                        The graphic representation of the Site, the texts, the images and all software compilations, the source code, the software itself as well as all material on the Site is the exclusive property of the Seller. All rights are reserved. Reproduction, modification, duplication, copying, distribution, sale or in any way exploitation of the images, contents of the Site is prohibited unless previously authorized in writing by the seller. Any use of the contents of the Site for commercial and/or advertising purposes is also prohibited.
                          12. Applicable law and competent court
                          These General Conditions are governed by the Consumer Code and by Legislative Decree 9 April 2003 n. 70 on electronic commerce. The Contract is governed and interpreted in accordance with Italian Law.

                          For the resolution of any civil disputes arising from the interpretation, execution and termination of this Contract, for the consumer user the mandatory territorial jurisdiction is that of the judge of the place of residence or domicile of the consumer, if located in Italy. For other users it is the Court of Padua.
