PRE-CONTRACTUAL INFORMATION - GENERAL TERMS AND CONDITIONS OF SALE
The general conditions of sale and use set out below (hereinafter the “General Conditions”) regulate access to and use of the website www.palomastore.it (hereinafter the “Site”) and apply to all sales (hereinafter the “Services”) provided by Paloma Store Srl, with registered office in Monselice (PD) – Via Verdi, n° 23/A - VAT number 05705110285 of which it is the owner (hereinafter the “Seller”).
The use of the Services is permitted to those who:
- both a consumer and a natural person, where consumer means a natural person acting for purposes outside of any entrepreneurial, commercial, craft or professional activity he or she may carry out;
- has reached the age of majority;
- have read the Privacy Policy relating to the processing of personal data;
- have accepted these General Conditions.
1. Object and scope of application
These General Conditions apply to the Services on the Site. Any new services will be subject to these General Conditions, unless otherwise specified on the Site.
The offer and sale on the Site constitute a distance contract governed by Articles 50 et seq. of Legislative Decree no. 206 of 6 September 2005 ("Consumer Code") and by Legislative Decree no. 70 of 9 April 2003, which governs electronic commerce.
These General Conditions of Sale may be updated or modified at any time, provided that the General Conditions published at the time the purchase order is placed apply to each purchase contract. To this end, users are encouraged to save a copy of the General Conditions from time to time.
2. Registration methods
Registration on the Site is free. The user declares that the information provided upon registration on the Site is correct, complete, and truthful. Upon registration, the user must also enter a password of their choice. Registration will be confirmed via email to the address provided by the user upon registration. The Seller guarantees that the Site access password will be used exclusively by the user and will not be disclosed to third parties. The user may change the password at any time by clicking on the Recover Password link. An email will be sent to the user to set a new password.
Please note that the data you provide when ordering and registering will be processed in accordance with current privacy legislation. Please refer to the privacy policy.
3. Product features
The products sold are those present in the electronic catalogue published on the Site at the time the order is placed by the buyer and are sold with the characteristics described on the aforementioned Site and in accordance with these general conditions of sale in the version published on the Site itself at the time the order is sent, with the exclusion of any other conditions or terms.
Please note that the product images and descriptions published on the Site reflect the actual characteristics of the products as faithfully as possible. It is understood that these images and descriptions may not be perfectly representative of the products and should therefore be considered indicative and subject to customary tolerances.
The products for sale on the Site, their prices, and/or features are subject to change without notice. Before submitting a purchase order, the buyer is invited to verify the final sale price.
4. Pre-contractual information
In accordance with Legislative Decree no. 70 of 9 April 2003, which contains provisions on electronic commerce, the seller informs the user that:
- To complete the purchase of one or more products on the Site, the user must complete an electronic order form by entering all his/her data (the user declares that the data provided at the time of the order is correct, complete and truthful) and follow all the different stages of the purchase;
- the user will be able to check and correct any data entry errors before sending the order;
- the contract is concluded when the order form is registered, after verifying the accuracy of the order and payment data;
- Once the order form has been submitted, the user will receive a confirmation email containing a summary of the General Terms and Conditions, information regarding the characteristics of the purchased product, a detailed price, the payment method used, and the methods for exercising the right of withdrawal. It is recommended that this email be retained as proof of purchase or stored on a durable medium.
5. Terms and conditions of purchase
The sale price, indicated in the description of each product, is expressed in Euros/€ and includes VAT. Shipping costs, which also include VAT, must be added to this amount. The product price charged to the user is the one listed on the Site at the time the order is placed, plus order processing and shipping costs. The price indicated at the time of purchase is not subject to change.
Except where expressly stated, no payment fees or other costs are due.
The products will become the property of the user upon payment of the price by the latter.
The purchase order will be processed only after receiving confirmation of authorization for payment of the total amount due, consisting of the purchase price and any additional costs, as indicated in the order form.
6. Payment form
Payment can be made online by credit/debit card or PayPal account.
Your credit card will be charged only after the credit card details used for payment have been verified and authorization has been released by the credit card company.
7. Delivery methods and times
The Seller processes orders Monday through Friday. Orders are processed the same day they are placed, or on the next available business day. Orders placed Friday afternoon through Sunday will be processed the following Monday.
Purchased products will be delivered to the address indicated by the Customer in the order within 24–48 business hours of shipment, at the cost specifically indicated on the Website before the order is placed. Once an order has been placed, it cannot be cancelled or changed. You can track the progress of your package using the tracking number provided by email directly from the BRT courier using a direct link. You can also check your tracking by entering this number on the BRT website under "Track Shipment."
The customer must provide complete shipping information, without omitting any important details for delivery. If any information is omitted or the address is incomplete, it will not be possible to make changes or additions. Shipping is handled by BRT throughout Italy at a cost of €6, paid by the customer. Shipping is free for all orders over €89. The customer will receive an email directly from BRT containing a link to track their order.
The Seller is not responsible for any delays and/or failed deliveries caused by incomplete or inadequately provided addresses at the time of ordering. Any delays will not entitle the buyer to claim damages of any kind.
In the event of significant delays in delivery, the Seller may initiate a report with the courier regarding a possible loss of the package. This process may take up to 14 business days to complete. Once the investigation is complete, the package may be located and automatically returned to BRT, or it may be declared permanently lost. Only in the latter case will the item be reshipped, subject to availability, or a full refund issued. It is not possible to proceed with a new shipment or refund until the courier has completed the verification process.
ATTENTION: BRT courier makes two delivery attempts. If the recipient is not present at the second delivery attempt, or the address is incomplete or incorrect, it will not be possible to reschedule the delivery and a hold will be requested. Once an order has been placed, it cannot be cancelled or changed.
8. Execution of the refund service
Upon conclusion of the contract, or upon payment of the price, the Seller undertakes to perform the requested services.
If the Seller is unable to ship the purchased product, it will promptly notify the user, who will be entitled to a full refund of the payment made within 15 (fifteen) days of sending the notification, excluding any further right of the user to refunds and compensation.
9. Warranty and return procedure in case of non-compliant product
Pursuant to and for the purposes of European Directive 44/99/EC, Legislative Decree 206/2005 and subsequent amendments (so-called Consumer Code), the Seller guarantees the buyer that the products will be free from design and material defects and conform to the descriptions published on the Site for a period of 60 (sixty) days from the date of delivery of the products. Any warranty does not apply in the event of use of the product in a manner that is not compliant with the product's intended use and the instructions/warnings provided by the Seller or reported in the relevant explanatory documentation, tags, or labels.
Under penalty of forfeiture of this warranty, the consumer is required to report any defects or non-conformities within and no later than 60 (sixty) days of discovery, by sending a communication to the email address customerservice@palomastore.it, and indicating the defect and/or non-conformity found as well as relevant photographic documentation.
Upon receipt of the request and related documentation, the Seller will verify and evaluate, through appropriate checks, the reported defects and nonconformities. The consumer will have the right to repair or replace the product, where possible given product availability, and unless the replacement or repair would be excessively costly for the Seller given the value of the product, the extent of the defect, and the possibility that the alternative remedy can be implemented without significant inconvenience to the consumer.
Should the Seller be required to refund the consumer the price paid, the refund will be made, where possible, using the same payment method used at the time of purchase or by bank transfer.
Procedures for returning non-compliant products:
- The user must send the request in writing as soon as possible and in any case within 60 (sixty) days of receiving the product, by sending an email to the following address customerservice@palomastore.it indicating the reason for the return and attaching relevant photographs;
- Products must be returned in their original packaging and appropriately packaged for safe shipping;
- Returned products must be delivered to the carrier within 7 (seven) days from the date on which the user communicated that the product is damaged or defective.
If the Seller does not acknowledge liability for damage to the returned product, it will send a notification that the returned product cannot be accepted. In this case, the user may request that the defective or damaged product be resent.
If the recipient of the product indicated on the order form is different from the person who made the payment for that product, the amount paid for the returned item will be refunded to the person who made the payment. The refund will be made using the same payment method used for the purchase.
The Seller will not be liable for any delays beyond its control, including delays caused by the method of purchase or refund, including, for example, delays caused by the refund policies of each credit institution.

11. Content of the Site and intellectual property
The graphic representation of the Site, the texts, images, and all software compilations, the source code, the software itself, and all material on the Site are the exclusive property of the Seller. All rights are reserved. Reproduction, modification, duplication, copying, distribution, sale, or any other exploitation of the images and content of the Site is prohibited without prior written authorization from the Seller. Any use of the Site's content for commercial and/or advertising purposes is also prohibited.
12. Applicable law and competent court
These General Conditions are governed by the Consumer Code and Legislative Decree no. 70 of 9 April 2003 regarding electronic commerce. The Contract is governed by and interpreted in accordance with Italian law.
For the resolution of any civil disputes arising from the interpretation, execution, and termination of this Agreement, for consumer users, the exclusive jurisdiction lies with the court of the consumer's place of residence or domicile, if located in Italy. For other users, the exclusive jurisdiction lies with the Court of Padua.
